This policy applies to the ChildSafe Limited suite of websites:

Some aspects of the policy are relevant only to users with login access to Safety Management Online.
1. Access and Use
- The use of this website is governed by these terms and conditions.
- Accessing or transmitting information or data, registering or otherwise participating in use of this website indicates your acceptance of these terms and conditions.
- ChildSafe Limited is not a law firm and does not provide legal advice.
- Your access to this site is provided to you by an organisation within which you are operating (unless you are the Site Administrator, in which case access has been provided directly by ChildSafe Limited). A Subscription Agreement is in place between your organisation and ChildSafe Limited, which details the basis by which this site is provided to you and to your organisation. The Subscription Agreement governs the relationship with Members, Partners and Full Customisation Users.
- You have been provided with an initial login using an email address and password. You need to safeguard these and not share your login with another user.
2. Linking to our Web Site & use of Logos
- You are welcome to link to our website (as long as our destination URL is clearly displayed in the address bar). You are welcome to use a copy of the SMO logo but only for the purposes of that linking. We reserve the right to require that you cease and remove links or logo use at any time.
3. Copyright
- The copyright in all products, information, text, graphics and other material on this Website ("Content") is owned by ChildSafe Limited.
- You must not modify, reproduce, re-supply, republish, frame, upload to a third party, post, transmit or distribute any part of the Content in any way without the prior written consent ChildSafe Limited. Where we have provided downloadable resources they are to be used only by organisations holding a current Subscription Agreement for SMO.
- All rights not expressly granted in these terms and conditions are reserved.
4. Fair Use Agreement for Resources on the ChildSafe Resources CD
- Our publications and web resources are kept affordable because the cost of their development is shared between the organisations that purchase them. As a non-profit Harm Prevention Charity, all funds we receive are applied to our objectives 'Safe People – Safe Programs'. When a person or organisation infringes our copyright, they impact adversely on those who have paid their fair share. Therefore we will act to protect our Intellectual Property when we need to. We would far prefer that organisations approach us in relation to use of any of our materials.
Acceptable Use
- We encourage you to use the resources on the CD, in conjunction with our publications and SMO, to set up processes that promote the safety of children in your organisation. We permit you to do the following:
- Save these resources (forms, checklists and training materials) to your computer, and make adjustments to them that will increase their effectiveness:
- Place your organisation’s name and logo within them.
- Add material that will make the resource apply to your context, but not detract, in our opinion, from the safety and care standards used within the ChildSafe System.
- Remove elements because they are not relevant to your situation, again as long as you are not lowering the safety and care standards used within the ChildSafe System.
- Make copies of these forms to be used within your organisation. These may be printed copies, photocopies, or electronic copies.
- Make these forms available for download from within a secure web site that is accessible only to your members. (If you subscribe to SMO, access is made available for all resources.)
Unacceptable use
- You must not remove our copyright notice, or delete the ChildSafe logo.
- You must not alter the resources in any way that detracts, in our opinion, from the safety and care standards within the ChildSafe System. If you are unsure whether this is the case, ask us.
- The forms are not to be made freely available for download from a publicly accessible website.
- You must not violate our rights under copyright law in other ways, such as copying sections of our resources and using them without appropriate permission, credit or licensing arrangement (depending on the circumstances).
5. Trademarks
- The trademarks displayed on this website are trademarks of their respective owners. All rights are reserved.
6. Links
- Links and third party products and services are provided for your convenience. We cannot however guarantee their content or uptime.
- The inclusion of any link does not imply any endorsement of the linked website.
7. Governing Law
- The applicable law is that of the State of Queensland in Australia.
- Users agree to submit to the non-exclusive jurisdiction of Courts of the State of Queensland in Australia, and the Federal Court of Australia and their appellate courts.
8. Compliance with laws outside Australia
- If you access this website from outside Australia, you are responsible for ensuring compliance with all laws in the place where you are located.
- ChildSafe Limited makes no representation that this Website complies with laws of any country outside Australia.

- ChildSafe Limited takes your privacy and security seriously.

15. Indemnity
- You agree to indemnify ChildSafe Limited (its directors, parents and affiliates and their respective officers and employees) against any cost incurred or damage or loss suffered by ChildSafe Limited (its directors, parents and affiliates and their respective officers or employees) as a result of your breach of obligation.
16. Severability
- If any part of any of these Terms and Conditions are held unenforceable, or invalid for any reason, it may be severed and these terms and conditions will otherwise remain in full force.

- You agree that ChildSafe Limited will track usage of this website and its products and services.
- You agree that ChildSafe Limited will keep records of online usage.
